An insurance cover for structural defects in buildings

HDFC Ergo has launched ‘Inherent Defects Policy’, a first-of-its-kind product in the non-life insurance sector.

The policy will compensate for the cost of repairing, restoring or strengthening of a new building or civil structures caused by inherent structural defect.

This product addresses one of the requirements of the recently enacted Real Estate (Regulation and Development) Act 2016 (RERA) that has mandated real estate builders to rectify any structural defects within thirty days, if brought to their notice in a period of five years from the date of handing over possession.

The cover is different from the standard property insurance cover. The inherent defects policy covers all those risks that are not covered by the fire policy. Besides structural defect, this will include poor workmanship. Since even small damages are covered, the premium is higher than what is paid out for property insurance.

The policy can be also be assigned to the new property owners. This means that if an apartment block is sold and the property is transferred to a cooperative society, the policy can be transferred to the society. Another reassurance from the policy provider is the knowledge that the project has been audited at the time of construction. The insurance company will appoint an independent technical inspection service to carry out monitoring activities on the quality of the building during the course of construction. This will include services ranging from sample design checks to witnessing tests at site.

The new policy can be obtained by the developer prior to the start of construction and will have five-year validity, which is co-terminus with the liability of the promoter under the new law.

 

Insurer’s study shows gaps in cancer preparedness

According to the findings of a national ‘Cancer Financial Preparedness Survey’ by Future Generali India Life Insurance (FGILI), conducted in association with IPSOS, a leading global research firm, about 69 percent of people have no financial preparedness to deal with cancer.

The study states that the majority of Indians will dip into savings or take a loan to finance treatment for cancer.

The findings include:

Incidence: More than half (56%) of respondents were unaware of the incidence of cancer among family and friends. This is alarming, given that oncologists opine that 3 in every 10 Indians are likely to contract the disease by 2020. The survey revealed that 65.7%   (2 out of 3) cancer patients were detected in the 3rd or 4th stage of cancer.

Stage: 42% of respondents perceived themselves to be “somewhat” in the know of the various stages of cancer whereas 28% of respondents thought they were “completely aware”. In contrast, the oncologists’ survey revealed that only about 7% of patients hold “complete awareness” of the different stages of cancer, while 30% possess a “reasonable understanding” of the same.

Type: All respondents claimed to know about the different types of cancer (breast cancer and lung cancer featured high on the awareness radar at 45% and 36% respectively) whereas oncologists revealed that only a quarter of the people who visited them knew about the different types of cancer.

Cost of treatment: The majority of respondents estimated that the average cost of cancer treatment was INR390,000 (US$6,000). Oncologists disclosed the average cost of treatment to be upwards of INR500,000 depending on the type of cancer and stage of detection.

Aadhaar made mandatory for insurance policies

In a directive issued yesterday, IRDA announced that Aadhaar number has to be linked to insurance policies under the prevention of money laundering rules for both existing and new policies.

IRDA said, “The Authority clarifies that, linkage of Aadhaar number to Insurance Policies is mandatory under the Prevention of Money-laundering (Maintenance of Records) Second Amendment Rules, 2017.

The move is in line with the government’s amended Prevention of Money Laundering Act requiring all financial services entities in India, including banks and mutual funds, to submit clients’ Aadhaar numbers and PAN for Know Your Customer authentication. PAN stands for Permanent Account Number, which is issued to each taxpayer. Since 1 July, the government has made linking the PAN with the Aadhaar mandatory for filing income tax returns and obtaining a new PAN.

All general, life and standalone health insurers have to comply with this directive with immediate effect.

All policyholders will have to link their policies and furnish the Aadhaar number. For existing policies, Aadhaar can be provided at the time of renewing the insurance cover.

Insurer expects it to help the sector in reducing frauds and quicker claim settlement.

Supreme Court : Insurance Claim Can’t Be Denied Due To Delay In Filing It

Granting relief to a man who was denied the claim for his stolen vehicle, Supreme Court said that insurance claims cannot be rejected if the reason for delay in filing it is explained satisfactorily.

The observations came as the bench allowed the appeal of a man against the ruling of the National Consumer Disputes Redressal Commission (NCDRC) that insurance firms could deny the claim benefit for delay in filing it.

According to the appeal filed by Om Prakash, his truck was stolen in Bhiwari in Rajasthan on March 23, 2010 but he filed the insurance claim on March 31 as during that period, he was busy trying to trace it. When his claim was denied due to late filing, he decided to approach National Consumer Disputes Redressal Commission (NCDRC) and after 7 years of wait, he won.

A bench of justices R.K. Agrawal and S. Abdul Nazeer at Supreme Court has ordered the insurance provider to reimburse Om Prakash, because a genuine delay of 7 days is not a sufficient reason to deny the claim.

The Bench observed that any victim will first attempt to locate his stolen vehicle, rather than approach the insurance provider straight away.

Reliance General Insurance Co. has been ordered to pay Rs 8.35 lakh to Om Prakash.

State government may launch public sector insurance company

The Maharashtra government may soon become a new player in the insurance industry. The state government is planning to set up an insurance company in a joint venture with a public sector insurer.

The proposed company will execute the state government’s general, life and medical insurance-based schemes for stakeholders like farmers, employees, and beneficiaries from the Below Poverty Line (BPL) and Above Poverty Line (APL) categories.

A senior state government official confirmed that the state government runs a number of insurance schemes and the Maharashtra government is examining the establishment of an insurance company to handle this. The company will collect premiums for various covers and settle claims.

The state’s finance minister Sudhir Mungantiwar confirmed that the idea is being contemplated and they are in discussions with the public sector insurance companies for a joint venture. This will enable the government to reduce costs.

The Maharashtra government covers various categories of beneficiaries like the 18 lakh state government employees who get medical and life insurance cover.

Officials, however, express concerns over the possibility of political interference in the claims payment process if the government ran insurance schemes. Also, there are worries over the state’s ability to approve claims.

Insurers fear deluge of flood claims

Since late June, several states like Assam, Bihar, Gujarat Haryana and Rajasthan have been hit by devastating floods, leading to heavy loss of lives and damage to livestock as well as property. The rising number of flood damage claims, pouring in from flood-hit states, has the general insurance sector worried.

It’s a matter of concern that catastrophic losses which are essentially Black Swan events, are happening every year. This will put considerable pressure on property pricing,” state-owned National Insurance Chairman Sanath Kumar told the news agency. National Insurance Company has received a total of 209 claims so far from Gujarat and Assam with a value of around INR230 million (US$3.6 million).

Mr M N Sharma, a director of, United India, said: “We’ve made a provision of INR150 million for claim settlement. But we fear the figure may increase.”

The death toll from monsoon floods in India, Bangladesh and Nepal climbed above 1,200 as at 25 August. All three countries suffer frequent flooding during the June-September monsoon season.

13 insurers in Blockchain Cooperation

Thirteen Indian insurance companies have rallied together to use a blockchain-like technology to create a central repository of policyholder data, to avoid repeating the registration procedure for holders of multiple policies.

A whole lot of work has to be done in know-your-customer, medical underwriting, financial underwriting, etc, when a customer buys insurance. Duplication of these procedures can be avoided by having the entire data set on blockchain. When the same records are available to a number of life insurance companies in a chain, the cost incurred by them is lower compared to what it is when they were all separately conducting tests and storing records.

There are regulatory concerns regarding data privacy that need to be addressed. Once the system evolves it would help in reducing cost and improving efficiency. The savings in financial overheads due to the new technology are yet to be seen. But the consortium members are confident that greater transparency and reduced duplication would be beneficial for everyone involved.  Interoperability with other insurance companies — apart from banks, medical centres, among others — would be the eventual goal.

 

Govt wants state-run insurers to turn around group health business.

The Finance Ministry has directed state-owned general insurers to put in place an appropriate mechanism for pricing group health cover, as this class of business has been reporting losses.

The mechanism is to take into account the existing incurred claim ratios, management expenses, medical inflation, commissions, likely increase in claims due to ageing, increase in size of the group and the cost of underwriting.The advisory from the ministry is part of the various circulars on corporate governance, profitability and underwriting prudence that the government sends out from time to time.

State-owned National Insurance said it does have a pricing mechanism for its corporate health insurance products. “We always take into consideration the incurred loss experience of the past two-three years, cost of operations and the projected outgo in the coming year. The renewal pricing of each large employee benefit programme of corporates is always based on these broad parameters and then finalised in case to case negotiations,” National Insurance Chairman Sanath Kumar said. Oriental Insurance Chairman A V Girija Kumar said, his company adopts careful underwriting of group health business, which is in line with commercial prudence.

 

Vehicles without clean pollution certificates to be denied insurance

The Supreme Court has directed that motor insurance renewals are not to be allowed without a valid Pollution Under Control (PUC) certificate for all types of automobiles, in a move to crack down on polluting vehicles.

The Court ordered insurance companies to refuse renewal applications for vehicles without pollution certificates. It accepted the recommendations of the Environment Pollution (Prevention and Control) Authority (EPCA) to ensure mandatory linking of the PUC certificate with the issuance of annual vehicle insurance policies. The Court acted on a report prepared by the EPCA that showed a very poor level of compliance with the PUC programme.

In Delhi, only 23% of vehicles are sent for PUC tests. With mandatory linking of vehicle insurance with the PUC certificate, the compliance level can improve significantly, especially as the Supreme Court has directed its enforcement nationwide. To improve the effectiveness of the PUC programme, the bench of judges also directed that PUC centres to be linked online and a data centre set up to prevent manual tampering. Currently, the system is seen as plagued with corruption, improper testing and non-functioning equipment;,fake certificates, lack of qualified PUC operators, and poor enforcement of calibration requirements for testing equipment. The new directives can help to improve compliance and management.

India has several cities rated as worst in the world for air pollution. For example, the annual average PM2.5 concentration in Delhi is typically more than 10 times the US National Ambient Air Quality Standard of 12 micrograms per cubic metre.

Biggest general insurer state-owned insurance entity to apply to float shares.

India’s largest general insurer, the government-owned New India Assurance, has filed a draft red herring prospectus with the Securities and Exchange Board of India for a public listing.The IPO comprises a fresh issue of 24 million shares by the company, and the sale of 96 million shares by the government. The flotation exercise is expected to raise around US$1.5 billion.

The public issue will result in a 14.56% stake dilution for the government in the general insurance firm. The government will have a grace period of three years from the date of listing to meet the minimum public shareholding requirement of at least 25% shares held by the public.

The shares will be listed on the Bombay Stock Exchange and the National Stock Exchange of India.
